3PM Friday

At 3:00 PM today (Friday) the Mayor Suttle Recall Committee will submit their gathered signatures to the Douglas County Election Commissioner.

As we (1st-ed-ly) noted earlier this week, the Recallers state they have enough signatures to initiate an up-or-down vote on Suttle. Channel 6 is reporting that they are looking at having 30% more than the 26,000+ sigs, anticipating that as many as that could be thrown out.  (If they have 33,000 signatures, they’ll need a lower percentage than that.)

Ah but hang on! Creighton Law Student, and anti-Recall spokesperson, Noelle Obermeyer says they are ready to depose the petitioners! (Assuming, of course, that she has taken Trial Practice at school.) So we are guessing the 15 day review process could get stretched out muuuuuch later.

(And for a chuckle, be sure to check out the undercover video they apparently provided to Channel 7.  Or maybe it's of the Blair Witch.  Be sure to take some Dramamine first.)
We still think that’s an awful lot of signatures they would hope to get rid of -- and note that in these types of cases, courts generally try not to go against voters’ intentions. So, for instance, if a petitioner didn’t read the entire statement, but the person still signed, a judge isn’t likely to throw it out.

But who knows? Anything can still happen right?

And does Jim Suttle benefit from the extended time to prep for a vote? Really depends on what sort of things happen between then and now, right?

In any case, Mayor Suttle is now saying that he won’t resign, if the signatures come in. His reasoning?
“I made a pact with the voters to serve four years...”
Really? A pact? When was this? And it was only with “the voters”? So not just with all the citizens of Omaha? It was with a subsection, i.e., just those who voted?

Well then, that must have been during the campaign sometime.

But a pact? Is that like a promise?

Like the one to lower property taxes?

We have so many questions...

Yeah, they tend to go with voter intent, unless there's a violation by the circulator that constitutes fraud.

You know, like not being a registered voter in Nebraska and then having someone who is sign as the circulator.

I'm still waiting for Suttle to live up to his campaign pitch. "To lower property tax". This idiot never had any intention of lowering any tax or "streamlining city services".

The requirement that signature collectors be registered Nebraska voters is under legal challenge, and will likely be struck down. It has no legitimate purpose except to restrict the democratic process.

If they have 130% of the legal requirement, it's unlikely the petition can be stopped.

But if it does, I can't wait for the depositions of the recallers and their financial backers as the signatures' validity is litigated. Oh, what secrets will be told -- under oath.

RWP, by that logic, voter registration has no purpose other than to restrict the democratic process. Or residency requirements for running for elected office.

The purpose is to prevent fraud, and to at least ensure that the people circulating petitions have a stake in the outcome.

Ya gotta remember it isn't just Suttle who is afraid of the people. More it's his puppet master's in the Union and other Liberal Progressive Organizations.

Yup all the Tom Whites, and Brad Ashfords won't be able to put Humpty Dupmed back in office again. And what's even funnier is these same individuals will be jockeying to take his place once he is removed!

Yup a very fair group of people running with Suttle these days.

The Recall Committee is now worried about how to get people to the polls, I guess Forward Omaha has decided to provide the motivation for them -- all on Dick Holland's dime. The Forward Omaha clowns are the gift that just keeps on giving!!!

I'm with RWP...is this Noelle Obermeyer any relation to that joke of a cartoonist Neal Obermeyer?

Anon 11:19, correct me if I'm wrong, but aren't the people who register voters paid for their work? And really, isn't the purpose of voter registration to prevent people from voting multiple times? So what is the worry...that people signed the petition multiple times?

If people are worried about fraud in the petitions, then it boils down to making sure there aren't repeated petition signatures, and that the signatures are legitimate. Whether a person is being paid to collect the signatures is immaterial as long as the signatures prove to be legit.

Be careful what you wish for NEVoter, depositions go both ways and all those paid anti-recall folks and the law school student will be subject to the same treatment. I wonder how Dick Holland, et.al., will like that process??? Does anyone really think that some BS legal challenge to the validated signatures is going to convince any likely voter to vote for Mayor Moron???

I find it pretty funny that people are complaining about the pending legal challenge. So you take issue with the fact that Suttle supporters are using the judicial system to circumvent your attempt at circumventing the electoral system?

At RightWing Professor: The fact that the people be registered voters is not a law "restricting" the democratic process. Are you kidding me? The right to vote is part of the democratic process! And if they didn't vote to put the mayor in office, they shouldn't vote to get him recalled!

Residency requirements for petition circulators have already been struck down by three federal appeals courts. Laws requiring petition collectors to be registered voters, which are even more onerous, are certainly not going to withstand legal challenge.

The major precedent in this area is Nader vs. Brewer. Yes, THAT Nader. The ultra-liberal Ninth Circuit struck down the Arizona law which required petition circulators be state residents. The USSC declined to hear the appeal.

(1) Circulators must be "electors" of the State of Nebraska, which means that they must be eligible to vote, not registered to vote.

(2) The mayor didn't hesitate in charging a wheel fee to nonresidents. Does anyone really think a court will tell those same people that are charged the fee that they cannot exercise their constitutional right and circulate a petition because they live across the river? Just because a court hasn't yet struck it down, doesn't mean it is constitutional.

I agree with almost everything you say, I'm a tried and true Republican, but I'm so sick of seeing these idiotic fights that you get into with anonymous bloggers, and frankly I don't care that you're a professor and I don't find you that interesting.
