HDTV - Daub on the air

Hal Daub is on the air with this first ad of the 2009 Mayoral campaign. It is entitled, "Hal Daub: We Need Him Now."

Not a bad piece, going back to Daub's initial presser on the crime issue. We'd argue that Daub is being more specific than his opponents as far as spelling out his plan, and this ad hits some of those elements.

One point where Daub has a big advantage on either Jim Vokal or Jim Suttle is that he doesn't have to waste air time introducing himself to voters. He is able to talk about his proven record, without trying to spell out where he's lived, what he's done, etc. etc.

One thing we found interesting was the last image used of Daub smiling. We've seen it before. Where?

Channel 7 did a story on the Jim Vokal poll from the other day. Daub's campaign manager Brinker Harding said, "It was an internal poll and we don't give a lot of credibility to his internal poll." Harding then made an interesting attack on the ad: It breaks the law.

Harding cited LB720 (now Neb.Rev.Stat. 49-1474.02) that when disseminating a "prerecorded message" the sender "shall include, immediately preceding the message, the name of the person making the expenditure".

Vokal put his name a the end of the poll, instead of at the beginning.

But the counter argument here (at least as we see it) is that it's a "poll" and not a "message". Is a question ("Who ya gonna vote for?") the same as a statement or request ("Tom Smith is the best. Vote for him.")?

Interesting question. Now will Jim Vokal have to spend another $28K to clear this one up?

I am pretty sure political polling does not require a disclaimer at the beginning. If you hold this standard then does Gallup have to follow suit? My guess is it will never happen.

What a cheap shot by political hack Brinker. Way try to redirect there DB. After this I feel like as a Citizen I should watch you and your campaign very closely. Wouldn't want to come close to breaking some 'evil' law.

Also, are you telling me that if you ID who the call is for at the beginning at the survey it wouldnt mess with he results? I received a hal daub survey the other day and was not told who it was by til the every end.....

This is actually significant because if you put the disclaimer at the beginning people don't get roped in as easily. When they hear a disclaimer they immediately know it's a political ad & many hang up. Vokal not complying with this law puts the other candidates at an unfair advantage when they do their polling. He should be punished.

I also fail to see where there is any attack at all on Vokal. Harding seems to me to be pointing out a fact, not attacking Vokal's character.

I haven't seen a single negative comment come out from the Daub campaign until they pointed out Vokal broke the law. Every single statement from Vokal, on the other hand, from the announcement onward, has been an attack on Daub.

I'm tired of Vokal's negativity. And he is not acting in good faith with the people of Omaha when he puts out misleading, flawed poll data that his own campaign manager single-handedly conducted.

Do we want this bozo committing these rookie mistakes on behalf of our city, as our mayor?!

It was a robo-call. It had a pre-recorded message. Pretty simple.

It's a poll and for pre-recorded polls the disclaimer must in the call but is not required until the end. THAT is the law.

Interestingly, if the poll is done by a live caller, they are NOT required to tell you who is paying for it UNLESS you ask. Then, they are required to tell you who they are polling for.

I'm disappointed, Sweeper. That's a pretty weak defense of a pretty obvious violation of the law.

Most people who do what Jordan McGrain does in Nebraska were following this bill all last year, and knew all about it. It was an issue because it was going to make robo polling more difficult for everyone. It went into effect Jan. 1.

Either:

1) McGrain/Vokal knew all about it and wilfully broke the law to gain an unfair advantage.

or

2) McGrain/Vokal didn't know about it, and committed yet another rookie mistake.

Either way, I think you brush it aside too flippantly.

Anonymous 9:39 -- The law went into effect Jan, 1. Follow Street Sweeper's link to LB 720 and read it for yourself. It's only 3 paragraphs long. But it's clear:

"Any person who [spends money] to disseminate by any means of telecommunication a prerecorded message or a recorded message relating to a candidate or ballot question shall include, immediately preceding the message, the name of the person making the expenditure."

When a news reporter show up at your door and says we're doing a story on a poll that shows you trailing and your response is "yeah, well, uh, the disclaimer!" then you are in deep, deep trouble.

Harding is the rookie.

Did Hal Daub create that ad five minutes before it went up on air? It's a bunch of stock photos and footage from two years ago.

They were obviously very hurried because they are obviously very worried. Vokal's ads are 100 times better than this boilerplate trash.

That is a quite a smile on Hal's pucker at the end of that thing, though.

Jim, you can't have your cake and eat it too.

How do you cut police, fire, ambulatory and other services to protect the public, yet say you want to fight crime?? Sounds like double talk and ignorance.

Also, can you tell me what Jim's plan on crime is? I can't seem to find it on his website. I only see the 30 second spot which only uses bullet points.

He was in the city council for 8 years and what did he do to fight crime? What did he do to reign in the mayor? Not much. Now he wants to be mayor? That is just crazy.

Hal has a plan for crime and to grow the economy and it begins with fighting crime and reducing crime and violent behavior.

Seems Jim is trying the aw, shucks way of getting elected. Not gonna happen.

Well Street Sweeper, you did it again. You have to post on Hal's ad, to show you're current, but you just can't help yourself -- trying to dilute its impact by showing it with an ad from 2 years ago. You are making yourself more and more irrelevant the more you show yourself to be a one-sided mouthpiece, and your blog is becoming a circus, where a lot of us thought it was going to be a good alternative source of journalism for this mayor's race. Unfortunately it's another deceptive, amateur practice by Jim Vokal. Hide behind an anonymous blog.

Not that I'm a HUGE Hal Daub supporter, but I welcome his commercials after listening to Bozo's wife at least 25 times. I can now push the mute button in my sleep after listening to Liz Vokal's Hillary Clinton cackle at the end of their commercial. Best of luck to you, Hal.

I can't wait to see Suttle's TV ad, if for nothing more than the comic relief. I'm still in the "none of the above" voting block given these three candidates for Mayor. I do know I won't vote for any candidate that thinks throwing more taxpayer money at poverty/youth intervention programs is a good idea to fight poverty and crime.

Why?? There are some GREAT programs out there that are already making a difference, but because of the way the economy is now, nobody is contributing money to these good causes. Also, grant money is drying up. We need these programs to help these troubled kids stay off the streets and steer them towards successful futures. I believe the city needs to give more money to proven youth intervention programs.

If you study the two still images of Hal Daub smiling from 2007 and 2009 you will note how much he's aged in these two years. I think age is going to be a big factor in this race, especially amongst the younger voters. Younger voters want someone they can relate to.

It must be nice to have wealthy friends and big time corporate supporters to help buy you the election. I find it outrageous that Daub and Vokal are spending money on TV commercials for a primary. This is a prime example of the privileged using their influence to put themselves in positions of power. If the last election taught us anything, it is that the people are ready for change.

It is interesting how Brinker Harding is now being hit for saying Jim Vokal's poll didn't comply with the statute. (by the way Vokal Camp it doesn't) Don't try to equate Brinker Harding with the Pit Yorkie Jordan McGrain. Slinging mud isn't Brinker's style like some other "Mavericks" running other races. Anyone that has watched the 3rd Floor of city hall over the years knows Brinker is a straight shooter. I do know in the last week many in the Chamber are concerned about Jim Vokal's flip/flops. Hey Sweeper: Do you have a photo of Jim Vokal windsurfing (ala John Kerrey 2004)?

Jim Vokal has some credibility problems downtown and his fund raising is showing it. I don't get THE PIT YORKIE to run a poll on my perceptions!!! I'm just one of the Leavenworth Street loyalists that posts here. Second it was the Vokal camp that distorted Daub's murder numbers and had the mess over Jim's WRITTEN statement to the Chamber. Unless Brinker Harding writes your responses to questionnaires, then how is he slinging mud???

The hometown security commissioner would be a person with one primary job responsibility and one primary criteria on which they would be evaluated: to lower the rate of violent crime in Omaha. The police chief does worry about the violent crime rate, but they have a lot of other things to worry about too. At least that's how I read it. (Did you read it before posting your complaint?)

The security commissioner would also have a background specifically in addressing violent crime. They may come from a background outside traditional police forces (i.e. federal agencies, private employment, etc.)

If we really are fed up with the number of murders, rapes, assaults, and other violent crimes in Omaha, and are serious about regaining control of our city, this seems to me to be a promising idea. At least it's out of the box.

This morning Hal became the first candidate to turn in over 1,000 signatures and file with the Douglas County Election Commission. The filing isn't due until March 6.

Maxwell got absolutely crushed in the precincts that are in CC district 3, including his home precinct. He still carries a large debt for that race too.

Buescher has been in the race since right after Vokal made his decision to run for Mayor. Maxwell knew this from the beginning.

Maxwell's decison, if he is running, makes it more likely the seat will change party hands. If Maxwell moves on to the general, he gets crushed by the same attacks that killed him last fall. If Maxwell and Buescher split enough votes, there may be two Democrats in the General.

It's a bad play by Maxwell. People need to support Buescher. It's his time.

Omaha World-Herald - 2/2/2009:

"With two months to go before the city's primary election, former Mayor Hal Daub's camp said today...[h]e has raised about $320,000 in contributions." Vokal "had raised about $162,000."
